Overheard in Law School

This is what I'm currently learning in Crim law regarding automatism:

"The sleep-sex case - Luedecke [2005] O.J. No. 5088 (Ont. C.J.). In this case, the psychiatrist testified that the accused who put on a condom, raised the sleeping complainant's skirt, removed her underwear, and then engaged is unwanted sexual relations with her did so while he was sleepwalking. The psychiatrist also testified that sleepwalking is not associated with a mental illness. As a result, the trial judge held that the accused was in a state of non-insane automatism during the offence and he was acquitted of the charge of sexual assault."

This case will be heard on appeal, just so you don't think the Canadian court systems are crazy.
